4. Legal Grounds for Processing

Your personal data may be processed on the legal grounds set out in Article 5 of the KVKK, including where processing is expressly provided for by law, necessary for the establishment or performance of a contract, necessary for the data controller to fulfil a legal obligation, necessary for the establishment, exercise or protection of a right, or necessary for the legitimate interests of the data controller provided that such processing does not prejudice your fundamental rights and freedoms.

Health data may be processed in accordance with Article 6 of the KVKK and applicable healthcare legislation, where necessary for preventive medicine, medical diagnosis, treatment and care services, or the planning and management of healthcare services, by persons subject to a duty of confidentiality.

5. Methods of Collecting Personal Data

Your personal data may be collected through:

• contact and appointment forms available on www.aycimsen.com,

• telephone,

• email,

• communications initiated through WhatsApp,

• direct communication with the medical practice,

• through wholly or partly automated means, or through non-automated means provided that the data form part of a data filing system.

6. Transfer of Personal Data

​

Your personal data may be transferred, where necessary and limited to the relevant purpose, to:

• authorised public institutions and authorities where required by law,

• authorised persons and organisations for the fulfilment of legal, financial or professional obligations,

• service providers providing website infrastructure, hosting, communications, information technology and data security services.

Where personal data are transferred to service providers located outside Türkiye, such transfers will be carried out in accordance with Article 9 of the KVKK governing international transfers of personal data.

7. Retention of Personal Data

Personal data are retained for as long as necessary for the purposes for which they are processed and in accordance with any retention periods prescribed by applicable legislation.

Once the purpose of processing and any applicable legal retention obligation cease to exist, personal data will be deleted, destroyed or anonymised in accordance with applicable legislation.

8. Your Rights Under the KVKK

Under Article 11 of the KVKK, you have the right to:

• learn whether your personal data are being processed,

• request information if your personal data have been processed,

• learn the purpose of processing and whether your personal data are being used in accordance with that purpose,

• learn the third parties to whom your personal data have been transferred,

• request correction of incomplete or inaccurate personal data,

• request deletion or destruction of your personal data where the applicable legal conditions are met,

• request that corrections, deletions or destruction be notified to third parties to whom the personal data have been transferred,

• object to a result arising against you as a consequence of the analysis of your personal data exclusively through automated systems,

• claim compensation if you suffer damage as a result of unlawful processing of your personal data.

Applications will be reviewed and responded to within the statutory periods prescribed by the KVKK and applicable legislation.
